Terms of Service

These Terms of Service govern your access to and use of Tabletop.ai (the "Service"). By creating an account or using the Service, you agree to these terms. If you do not agree, do not use the Service.

1. What the Service is, and is not

The Service provides digital cyber incident-response tabletop exercise scenarios and a web application to run them and generate a report. It is a pre-incident rehearsal and documentation tool. It is not legal advice, not a security audit, not incident-response or recovery services, and not a guarantee that you will pass any audit, satisfy any regulation, or prevent or survive any real attack. You are responsible for your own security and compliance decisions.

2. Your account

You sign in with a one-time link sent to your email. You are responsible for keeping access to that email secure and for all activity under your account. You must provide accurate information and be at least 18 years old and authorized to act for your organization.

3. Access and license

Access to the platform and its exercise content is provided to your organization under your agreement with us. We grant you a limited, non-exclusive, non-transferable license to use the platform, the exercise scenarios, and the reports it generates within your own organization. You may not resell, sublicense, publicly redistribute, or share the scenario content outside your organization, and you may not use it to build a competing product.

4. Service availability and changes

We work to keep the service available and improving, but we may update, change, or discontinue features. If something is wrong, contact us and we will try to make it right in good faith.

5. Acceptable use

Do not misuse the Service: no unlawful use, no attempts to breach or disrupt the Service, no reverse engineering, no automated scraping of content, and no use of the content to create a similar or competing offering. We may suspend accounts that violate these terms.

6. Intellectual property

The Service, the scenario content, and all related materials are owned by us and protected by intellectual-property laws. Your license under Section 3 does not transfer ownership. The report your exercise generates, and the information you enter, belong to you.

7. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that it will produce any particular outcome with any auditor, insurer, or regulator.

8. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim.

9. Indemnification

You agree to indemnify and hold us harmless from claims arising out of your use of the Service or your violation of these terms.

10. Changes and termination

We may update these terms or the Service over time; material changes will be reflected by the date above. We may suspend or terminate access for violations of these terms. You may stop using the Service at any time.

11. Subscription and billing

Paid plans are monthly subscriptions billed in advance through Stripe, our payment processor. Each subscription auto-renews every month until you cancel. You can cancel anytime from the billing portal; the cancellation takes effect at the end of your current billing period, and you keep access until then. Fees are non-refundable except where the law requires otherwise. We may change prices with advance notice, and applicable taxes may be added.

Your plan sets the limits on seats and on business units (affiliates). Your entire organization tree, the host organization together with its business units, bills as a single subscription. If you cancel or let the subscription lapse, you keep the ability to download deliverables you have already generated, but you cannot run new exercises or generate new deliverables until you re-subscribe.

12. Governing law

These terms are governed by the laws of the State of [Your State], without regard to conflict-of-laws rules, and any disputes will be resolved in the courts located there.
